A place for folks to provide information as to what is going on in biking in WV. This information will be used to respond to the League of American Bicyclists survey due March 2009. This survey is used to rank states. The League of American Bicyclists announced their first annual ranking of Bicycle Friendly States, scoring all 50 states on more than 70 factors. WV came in last. We think it is a lack of information. Help us gather information. Thank you!

While the WV code excludes human powered vehicles from its definition of vehicle, it also says that every person riding a bicycle upon a roadway shall have the same rights and be subject to the same duties as the driver of a vehicle, under the "rights" part of this statement, one can argue that the distance a motorist must provide when passing a vehicle also applies to a motorist passing a bicycle.
§17C-7-3. Overtaking and passing vehicle proceeding in same direction -- Passing on the left generally; penalty.
(a) The following rules shall govern the overtaking and passing of vehicles proceeding in the same direction, subject to these limitations, exceptions, and special rules hereinafter stated.
(1) The driver of a vehicle overtaking another vehicle proceeding in the same direction shall give an audible signal and pass to the left thereof at a safe distance and shall not again drive to the right side of the roadway until safely clear of the overtaken vehicle.
